Finally, once the employee has reached maximum medical improvement, and is no longer totally disabled, he or she is entitled to a lump sum settlement to compensate for any permanent disability. The value of the workers compensation disability claim is governed by the degree of disability as measured on an industrial basis that the worker continues to suffer even after having made maximum medical improvement.
